1.1 Acceptance of Terms

By accessing and using TherapyBro (including the app, website, and related services), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the platform.

1.2 Platform Overview

TherapyBro is a non-clinical emotional support platform. It is NOT:

  • A medical service, therapy provider, or clinical treatment platform
  • A replacement for professional mental healthcare
  • A crisis hotline or emergency service

TherapyBro IS a companion app with:

  • An AI conversational companion ("Adam" or "Eve") available 24/7
  • Access to trained peer listeners and counselors for per-minute chat
  • Tools for journaling and mood tracking

1.3 Eligibility

You must be at least 18 years old to use TherapyBro. By using the platform, you represent that you meet this requirement. Users under 18 are not permitted.

1.4 User Conduct

You agree to use TherapyBro only for lawful and non-harmful purposes. You will NOT:

  • Use abusive, harassing, or threatening language toward AI companions or listeners
  • Attempt to harm listeners or other users
  • Share explicit, illegal, or hateful content
  • Attempt to reverse-engineer, hack, or exploit the platform
  • Use the platform to solicit illegal activities

TherapyBro reserves the right to suspend or terminate your account for violation of these terms.

1.5 Payment Terms

  • Free tier: 10 minutes per day of AI chat. Resets daily at 12:00 AM IST.
  • Unlimited Adam: ₹5 per day for unlimited AI chat (soft fair-use cap). See pricing for current rates.
  • Listener sessions: ₹14 per minute (or current rate on the app). Charged per minute of actual session time. Minimum 8-minute wallet balance required to initiate.
  • Wallet: Prepaid balance for listener sessions. Top up via Razorpay/Cashfree. Withdraw to your registered bank account anytime (INR only; processing 1–2 business days).

1.6 Refund Policy

Listener sessions: No refunds for sessions already completed. If dissatisfied, submit a session rating and optional feedback. TherapyBro support will review disputes.

Wallet balance: Can be withdrawn to your registered bank account anytime (processing: 1–2 business days).

Subscription: Cancel anytime. No refund for the current billing cycle. Cancellation is effective after the current period ends.

1.7 Cancellation

You can cancel your subscription anytime via Settings → Manage Subscription → Cancel. No questions asked. One-tap cancellation. Confirmation sent via email.

1.8 Liability & Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW:

TherapyBro is provided "as is" without warranty. We do not guarantee any therapeutic outcome, emotional relief, or results from using the platform.

TherapyBro is NOT liable for: mental health crises, self-harm, suicide risk, or any adverse outcomes resulting from use of the platform.

AI Companion Limitations: Adam/Eve are conversational AI, not clinicians. They do not diagnose, prescribe, or provide medical advice. They are trained for emotional support only.

Listener Limitations: Listeners are trained peers or counselors, NOT licensed clinical psychologists. They cannot diagnose, prescribe, or provide clinical treatment. Listeners are emotional support providers only.

Crisis Protocol: If you express suicidal intent or self-harm risk, TherapyBro will escalate you to emergency services (108) and/or crisis lines (Tele-MANAS 14416). Escalation is automatic. Listeners are trained to support you during this process.

1.9 Liability Cap

TherapyBro's total liability to you under these Terms is LIMITED TO the lesser of:

  • The amount you paid TherapyBro in the past 30 days, OR
  • ₹5,000

This cap applies to all claims: contract, tort, negligence, or otherwise. This does NOT apply to liability that cannot be legally limited (e.g., gross negligence, willful misconduct).

1.10 Indemnification

You agree to indemnify, defend, and hold harmless TherapyBro, its founders, employees, and contractors from any claims, damages, or liabilities arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of applicable law
  • Your interaction with listeners or other users

1.11 Intellectual Property

All content on TherapyBro (app design, logos, features, chat interface) is owned by TherapyBro. You may not copy, modify, or redistribute without permission. Your data (chat history, journal entries, mood logs) remains your property. You grant TherapyBro a license to store, process, and use this data to improve the platform.

1.12 Third-Party Services

TherapyBro uses third-party services: Razorpay/Cashfree (payments), Firebase (push notifications), cloud storage (AWS/GCP). We are not liable for their outages or failures. See their terms of service.

1.13 Termination

TherapyBro may terminate your account at any time for: violation of these Terms, non-payment, or suspected misuse. Upon termination, you lose access to your account. Chat history is retained for 30 days, then deleted (unless required for legal hold).

1.14 Modifications to Terms

TherapyBro may update these Terms at any time. Changes take effect 30 days after posting. Continued use means acceptance. Material changes will be announced via email.

1.15 Force Majeure

TherapyBro is not liable for failures due to: server outages, natural disasters, government action, internet provider failures, or other events beyond our control. We will make reasonable efforts to restore service but provide no liability.

1.16 Dispute Resolution

Jurisdiction: Jaipur, Rajasthan, India

Governing Law: Laws of Rajasthan and applicable Indian federal law (IT Act 2000, DPDP Act 2023, MHCA 2017)

Arbitration: Any dispute must first be resolved via good-faith discussion between you and TherapyBro support (support@therapy-bro.com). If unresolved within 30 days, disputes are subject to arbitration under the Arbitration and Conciliation Act, 1996. Single arbitrator, seat in Jaipur. Language: English.
